By accessing or using Send A Song, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service.

2. Description of Service

Send A Song provides AI-powered personalized music generation services. We use artificial intelligence to create custom songs based on user-provided information.

3. User Accounts

To use our service, you must:

• Be at least 13 years old
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access

4. Subscriptions and Payments

Subscription Plans:

• Free: 3 songs included, no recurring charge
• Basic: $9.99/month, 10 songs per month
• Premium: $29.99/month, 50 songs per month
• Pro: $99.99/month, 20 songs per month with advanced features, video generation, commercial rights

Payment Terms:

• All payments are processed securely through Stripe
• Subscriptions auto-renew unless cancelled
• You can cancel anytime from your account settings
• Refunds available within 7 days of purchase (see Refund Policy)
• Unused credits roll over while subscription is active

5. Song Storage and Deletion

Default Storage:

• Songs are stored for 30 days by default
• Reminder emails sent 7 days and 3 days before deletion
• Songs are permanently deleted after expiration
• We are not responsible for songs you fail to download

Extended Storage:

• Available for purchase before expiration
• Prices: 30 days ($2.99), 90 days ($7.99), 1 year ($19.99), Lifetime ($49.99)
• Once expired and deleted, songs cannot be recovered

6. Acceptable Use

You agree NOT to:

• Use the service for any illegal purpose
• Create content that is offensive, defamatory, or infringes on rights of others
• Attempt to reverse engineer or hack our systems
• Abuse or overload our infrastructure
• Share your account with others
• Resell or redistribute songs commercially without permission

7. Intellectual Property Rights

Your Content:

• You retain ownership of the information you provide
• You grant us license to use your information to create songs
• Generated songs are licensed to you for personal use

Commercial Use:

• Songs are for personal use only by default
• Commercial use requires special licensing (contact sales)
• Pro plan may include commercial usage rights

8. AI-Generated Content

You acknowledge that:

• Songs are generated by artificial intelligence
• Results may vary and are not guaranteed to meet specific expectations
• We use multiple AI providers (OpenAI, AllMusicAPI, Udio, etc.)
• If AI generation fails, manual generation may be used
• We make reasonable efforts to ensure quality

9. Manual Generation

When automatic AI generation fails:

• Your request enters our manual generation queue
• Our team will create your song within 24-48 hours
• No additional charge for manual generation
• You will be notified when your song is ready

10. Refund Policy

We offer refunds under these conditions:

• Within 7 days of purchase or subscription charge
• If you're not satisfied with the quality of your song
• Technical issues that prevent service use
• Contact support to request a refund
• Refunds are at our discretion for abuse prevention

11. Service Availability

We strive for high availability but:

• Cannot guarantee 100% uptime
• May perform maintenance that temporarily interrupts service
• Are not liable for losses due to service interruptions
• May modify or discontinue features with notice

12. Limitation of Liability

To the fullest extent permitted by law:

• Service is provided "as is" without warranties
• We are not liable for indirect or consequential damages
• Maximum liability limited to amount paid in last 12 months
• We are not responsible for third-party services or content

13. Termination

We may terminate or suspend your account:

• For violation of these terms
• For fraudulent or illegal activity
• If account is inactive for extended period
• At our discretion with or without notice

Upon termination, your access ends immediately and songs may be deleted.

14. Changes to Terms

We may modify these terms at any time. We will notify users of significant changes via email. Continued use after changes constitutes acceptance.

15. Governing Law

These terms are governed by the laws of the jurisdiction where our company is registered. Disputes shall be resolved through arbitration.
